Divorce

A divorce is the dissolution of a marriage.  In the state of California there is a residency requirement of six months, which means you have to have lived in the state for at least six months before filing for divorce.  There is also a six month waiting period which begins the day you file for divorce.  In some cases, couples opt for legal separation rather than divorce. 

Legal Separation

A legal separation is the filing of a lawsuit which gives the Pasadena court the power to make all decisions related to a marriage, including: custody, division of property, and child and spousal support.  A legal separation is just like a divorce with the exception of the dissolution of the marriage.  For a complete divorce, additional paperwork must be filed.

Unlike a divorce, both spouses must agree to a legal separation.  If both parties do not agree the separation becomes a divorce. There are no residency requirements in the state of California for a legal separation, and there is no waiting period with a legal separation.  It is important to remember that neither spouse is permitted to remarry if they are legally separated.  In some cases prenuptial agreements simplify the separation and/or divorce process.

Prenuptial Agreements

A Prenuptial, or postnuptial, agreement outlines the way in which personal property is to be allocated between spouses in the event of divorce or death if there is no valid will or trust.   There is plenty of room for error when drafting a prenuptial agreement, it is best to consult a Pasadena matrimonial law attorney during this process.
